100wish. Terms of Use

These Terms of Use (the "Terms") govern the use of the application "100wish." (the "App") and related websites, APIs, and cloud services (collectively, the "Service") provided by the Service Operator (the "Operator"). By installing, accessing, or using the Service, users (the "User") are deemed to have agreed to these Terms.
Article 1 (Application)
- These Terms apply to all relationships between the User and the Operator regarding the use of the Service.
- The Operator may establish individual provisions and guidelines (such as "Privacy Policy") for the Service. These constitute part of these Terms.
Article 2 (Account & Authentication)
- The Service uses Firebase Authentication. Initial sign-in is performed anonymously.
- Device Migration:
- Currently, Apple account linking functionality is not implemented, so data transfer during device migration is not possible.
- The Operator assumes no responsibility for device migration failures or data loss.
- Maintenance & Service Suspension:
- The Operator may temporarily suspend the service without prior notice for maintenance, system updates, or bug fixes.
- The Operator assumes no responsibility for damages caused by maintenance suspension.
Article 3 (Service Content)
The Service provides the following features:
- Wish list creation and management by year
- Photo recording when wishes are achieved (front and back of cards)
- NextPick functionality (random selection for next challenge)
- Progress tracking and statistics
- Shared lists with family and friends (Premium feature)
Article 4 (Paid Features & Subscription)
- Some features of the Service (shared list creation (up to 10 per year), member invitations (up to 5 per list), etc.) are provided as paid subscriptions (the "Premium Plan"). Pricing, payment terms, renewal, and cancellation conditions follow the in-app display or store display.
- For iOS version, payments are made through Apple's In-App Purchase, and billing and refund policies follow Apple's terms. The Operator is not involved in store operator review or billing systems and does not provide direct refunds.
- The validity of the Premium Plan is determined by the Operator based on verification by the Operator or linked services (e.g., RevenueCat), through custom claims granted by the Operator. When the validity period expires or is cancelled, access to premium features is suspended.
- When billing is stopped, joined lists become unviewable, and only the oldest owner list is displayed. If billing is resumed, all lists become viewable again.
Article 5 (Content Handling)
- Users guarantee that they have the necessary rights for photos, text, etc. (collectively "User Content") that they post or upload, and that they do not infringe on third-party rights.
- Users grant the Operator a non-exclusive license to save, process, and display User Content within the scope necessary for Service provision, improvement, backup, and bug fixes.
- The Operator may delete, hide, or restrict access to User Content that may violate laws or these Terms as necessary.
Article 6 (Prohibited Activities)
Users may not engage in the following activities when using the Service:
- Activities that violate laws or public order and morals
- Activities related to criminal acts
- Activities that infringe on copyrights, trademarks, or other intellectual property rights
- Activities that destroy or interfere with the Service's servers or network functions
- Commercial use of the Service without permission
- Activities that may interfere with the Service's operation
- Unauthorized access or attempts
- Reverse engineering, decompilation, disassembly, or other analysis of the Service
- Other activities deemed inappropriate by the Operator
Article 7 (Service Suspension & Termination)
- The Operator may suspend or terminate all or part of the Service without prior notice in the following cases:
- System maintenance or updates
- When the Service cannot be provided due to fire, power failure, natural disasters, or other force majeure
- When system failures or other operational issues occur
- When the Operator determines that Service provision is difficult
- The Operator assumes no responsibility for any damages incurred by Users due to Service suspension or termination.
Article 8 (Disclaimer)
- The Operator provides the Service "as is" and does not guarantee that the Service will meet User needs, have specific functions, commercial value, accuracy, or usefulness.
- The Operator assumes no responsibility for any damages incurred by Users due to the Service, except for cases of intentional or gross negligence by the Operator.
- The Operator assumes no responsibility for transactions, communications, or disputes between Users and other Users or third parties regarding the Service.
Article 9 (Service Changes)
The Operator may change the Service content without prior notice to Users, and assumes no responsibility for any damages incurred by Users due to such changes.
Article 10 (Terms Changes)
The Operator may change these Terms at any time. When changes are made, the Operator will notify Users by posting the changed Terms on the Service or through other appropriate methods. If Users continue to use the Service after the Terms are changed, they are deemed to have agreed to the changed Terms.
Article 11 (Data Management & Deletion)
- Automatic Deletion Conditions: If 180 days or more have passed since the User last used the Service, the Operator may delete all or part of the User's information and content without prior notice.
- Deletion Target Data: The deletion target includes all of the following data:
- User profile information (display name, avatar image, etc.)
- Wish lists (titles, tags, notes, photos (front and back), etc.)
- NextPick information (random selection status, next challenge decision information, etc.)
- Shared list information (list settings, member information, etc.)
- Subscription information (plan type, validity period, etc.)
- Access logs, crash logs, and other technical information
- No Prior Notice: Data deletion is performed without prior notice to Users.
- User Responsibility for Backup: Users are responsible for backing up important data themselves.
- Irreversibility of Deletion: Deleted data cannot be recovered in principle.
- Legal Retention Obligations: Data required to be retained by law may be retained even after the deletion period.
Article 12 (Governing Law & Jurisdiction)
- These Terms are governed by Japanese law.
- In case of disputes regarding the Service, the court with jurisdiction over the Operator's location shall have exclusive jurisdiction.
